Docket DC-24-0002: Text Amendments to the Land Use Code Related to Residential Occupancy
Land Use Code Update Prompted by New State Law HB24-1007, the Harmonizing Occupancy Measures Equitably Act
|
Boulder County, Colo. - In response to HB24-1007, the Harmonizing Occupancy Measures Equitably Act, which prohibits local governments from limiting occupancy in a dwelling unit based on familial relationship, the Boulder County Community Planning & Permitting (CPP) Department is proposing a Land Use Code (Code) amendment in Docket DC-24-0002: Text Amendments to the Land Use Code Related to Residential Occupancy.
The proposed amendments to the Code would replace the approach utilizing the term Family with one which would regulate occupancy in residential dwellings based on relevant health and safety standards, instead of familial relationship, to prevent overcrowding and unsafe living conditions. The Code currently utilizes the Family definition to regulate occupancy in residential dwellings. Proposed text for the Code amendment will be available online once developed by staff.
Public comment will be accepted by CPP during the development of the proposed regulations. All responses will be made part of the public record. If you would like your responses included in the staff packet for Planning Commission, please return them no later than June 4, 2024. Responses received after this deadline will be shared with the Planning Commission and incorporated into the staff packet for the Board of County Commissioners public hearing.
Please provide any written comments by letter to the Community Planning & Permitting Department at P.O. Box 471, Boulder, Colorado, 80306, or via email to cbyrne@bouldercounty.gov.
The text amendment process will include public hearings before the Boulder County Planning Commission and the Board of County Commissioners. Public comment will be taken at both hearings.
