Evictions and Writs of Restitution

Evictions and Writs of Restitution

The following information is not intended to be legal advice and does not address the specific statutory or legal issues of evictions and Writs of Restitution.

Our Intent

We seek to provide the public with information and general guidelines regarding Sheriff’s Office policy and procedure for executing Writs of Restitution (Eviction).

We recommend that you personally research the statutes, or contact an attorney or the courts before proceeding with any action.

Civil Evictions (General Outline)

The eviction process begins when the property owner or landlord provides the tenant with a written notice (demand) to vacate. This notice informs the tenant of the reason for the eviction and gives them a specified period to either resolve the issue (if applicable) or vacate the premises.

If the tenant does not comply with the notice to vacate, the property owner must file a Summons for Forcible Entry and Detainer (FED) in court. This legal action seeks a court order for possession of the property. If the court grants possession to the landlord, they can proceed to obtain a Writ of Restitution.

The Writ of Restitution is a court order authorizing the Boulder County Sheriff’s Office to execute the eviction.

  • How to Schedule: Bring the Writ of Restitution to the Boulder County Sheriff’s Office Civil Section to schedule the eviction. Due to high demand, it may take several weeks before the eviction can be completed. Keep in mind the Writ of Restitution is only valid for 49 days.
  • Execution of Eviction: Only sheriff’s deputies are authorized to carry out evictions. When scheduling, Civil Section staff will provide an Eviction Information Form to complete.
  • Fees: The cost for executing an eviction is $160, plus mileage.

NOTE: CIVIL STANDBYS are not automatic; please contact the Civil Section with questions.
