Press Release – Charges Filed in Vehicular Fatality Involving Pedestrian



Boulder County, Colo. -- On July 8, 2024, at approximately 5:46 p.m., Mary Landry (DOB: 10/17/1960) drove her 2014 Lexus RX eastbound on Via Appia Way at the intersection of Sagebrush Way in Louisville. Judy Florian, 59 years old, was crossing Via Appia Way in the crosswalk after having activated the flashing crosswalk lights. A witness to the crash stated that Landry came over the hill and struck Florian, who was sent airborne 12-13 feet. She died from her injuries on the scene before first responders arrived.

The Louisville Police Department (LPD) investigated this tragic crash. When LPD completed their investigation, they consulted with the District Attorney’s Office for charges. In any crash that results in a loss of life, it is the specific conduct of the driver that determines what, if any, criminal charges can be filed. Depending on a driver’s actions, a vehicular fatality can be classified as the result of an accident, careless driving, reckless driving or driving under the influence, or intentional conduct.

On November 24, 2024, a summons was issued charging the defendant with Careless Driving Resulting in Death, a class 1 traffic misdemeanor and Misuse of a Wireless Telephone While Driving Resulting in Death, a class 1 traffic misdemeanor.

Louisville Chief Rafael Gutierrez stated, “Our thoughts remain with the family and loved ones of Judy Florian during this difficult time. The conclusion of this investigation marks an important step toward understanding the circumstances of this tragic incident. We are committed to transparency and accountability in all that we do, and we hope the findings provide some clarity to the community. I want to thank our dedicated officers and detectives for their thorough and professional work. Our department will continue to work tirelessly to ensure the safety of everyone in our community.”

District Attorney Michael Dougherty stated, “The life of Judy Florian was cut tragically short. Her death is devastating for her family, friends, and the community. I appreciate the thorough investigation conducted by Chief Gutierrez and the Louisville Police Department, as well as their continued collaboration with the District Attorney’s Office. Our office is committed to fighting for the right outcome.”

As in every criminal case, these charges are merely an accusation, and the defendant is presumed innocent unless or until proven guilty.
