DC-16-0005: Text Amendments related to Article 4-802.B.3.a of the Site Plan Review regulations

Proposed Boulder County Land Use Code text amendment to amend Article 4-802.B.3.a, which specifies the allowable timeline to restore a damaged or destroyed structure without Site Plan Review in unincorporated areas of Boulder County.

Background

On September 20, 2016, the Board of County Commissioners (BOCC) authorized text amendments to the Land Use Code to extend the timeline to rebuild a damaged or destroyed structure after a natural disaster. The proposed Code change will give affected property owners more time — one year vs. 6 months — to rebuild after a disaster, like the recent Cold Springs Fire, without triggering Site Plan Review.

The current Site Plan Review (“SPR”) regulations require a property owner to apply for a building permit within 6 months of the event (and rebuild in the original location, floor area, and height) in order for the rebuild to proceed without needing SPR and only a building permit. Although the Director has the ability to extend the 6-month time period in the case of extenuating circumstances, a blanket extension of this SPR-exempt time period will provide relief to homeowners who may be feeling pressured to meet this time constraint while they are still working out settlements with their insurance companies or dealing with other complications.

The Planning Commission considered these changes at a public hearing on November 16, 2016 and voted (6-0) to approve and recommend approval of the docket to the BOCC. The BOCC considered these changes at a public hearing on December 1, 2016 and voted to approve the changes.
