Boulder County, Colo. - The District Attorney’s Office is providing the following information regarding a pending criminal case and the subsequent officer‑involved shooting in Longmont. The tragic shooting took place on August 10, 2026. With the identification of the individual, as well as the existence of the underlying case, being made public, the District Attorney’s Office is able to provide this update.

Dariss Yearby, the person killed in this incident, had a felony domestic violence case pending at the time of his tragic death. That case involved the same victim as the person involved in the August 10th incident.

On February 20, 2025, the police responded to a hospital after the victim reported being strangled multiple times and losing consciousness. Medical staff documented extensive bruising to the victim’s neck, petechiae in both eyes and inside the mouth, and injuries indicating a substantial risk of death or long‑term impairment.

The victim reported that over the course of approximately an hour, the defendant assaulted and strangled her roughly 15 times, using one hand, both hands, and a chokehold maneuver, while preventing her from escaping. She lost consciousness at least twice during the assault.

Charges and Case Status

The defendant was charged with:

• Assault 1 – Strangulation DV (F3)
• Assault 2 – Strangulation DV (F4)
• False Imprisonment – Minor DV (F5)
• Assault 3 DV (M1)
• Attempted Murder 2 - DV(F3)

The case had been set for jury trial on December 14, 2026.

Bond History

On April 2, 2025, the District Attorney’s Office requested a $100,000 cash/surety bond due to the lethality risk and seriousness of the case. The defense requested a personal recognizance bond. The court granted a $20,000 personal recognizance bond with conditions including no contact with the victim, no substances, participation in monitoring programs, and no weapons. The defendant was released.

On May 21, 2026, the District Attorney’s Office learned the defendant violated the protection order by contacting the victim. A motion to modify bond was filed by the District Attorney’s Office. Pursuant to the Court’s Order, the defendant was arrested on May 27, 2026. At a hearing on May 28, 2026, the District Attorney’s Office again requested a $100,000 case/surety bond. The judge imposed a $20,000 cash/surety bond with no cash‑only option, citing victim safety and case integrity. The defendant bonded out of the Jail on June 10, 2026.

Trial Setting and Continuance

The case was originally set for trial on March 6, 2026, then scheduled for a five‑day trial beginning July 20, 2026. On June 30th, the defense moved to continue the trial due to the volume of discovery. Prosecutors objected to any delay in the July trial date. Over the prosecutor’s objection, the Court granted the continuance, resetting trial to December 14, 2026.

Officer‑Involved Shooting (August 10, 2026)

On August 10, 2026, at approximately 2:50 p.m., Longmont Police Officers responded to a domestic‑related disturbance near Creekside Drive and Eagle View Circle. The Longmont Police Department notified the community and media of the shooting and the circumstances known at the time.

This incident remains under active investigation. The Boulder County Investigation Team, also known as the Boulder Critical Incident Team (the "BCIT"), is investigating this case. The BCIT is conducting a full, independent review. This multi-agency team is designated to investigate use-of-force incidents in which any law enforcement officer within the 20th Judicial District uses deadly, or potentially deadly, physical force against a person, while acting under the color of official law enforcement duties. The BCIT investigation is being conducted for the purpose of determining whether criminal charges are warranted against any member of law enforcement involved in this incident.
