Press Release – Charges in Fentanyl Death Investigation
Boulder County, Colo. - Joseph Robert Moczulewski (DOB: 04/01/1982) was found deceased on March 2, 2026, at 7:18 am near Broadway and Yarmouth Avenue. An autopsy determined that his cause of death was fentanyl intoxication.
On April 23, 2026, Boulder County Drug Task Force conducted an undercover operation during which Gustavo Argumedo-Lopez (DOB: 8/20/1994) sold 4.41 grams of methamphetamine to an undercover detective. At the time of his arrest, Mr. Argumedo-Lopez was also in possession of an additional 52.34 grams of methamphetamine and 1.31 grams of fentanyl. He conducted the drug transaction near his residence which was also within 1,000 feet of a school.
According to the arrest affidavit, Mr. Argumedo-Lopez confessed to selling illicit drugs to Mr. Moczulewski the night of his death. Digital evidence gathered through the investigation of Mr. Moczulewski’s death revealed the same phone number from Mr. Argunedo-Lopez’s phone which was seized during his arrest.
The DA’s Office filed the following charges:
- Count 1: Distribution of a Controlled Substance–Fentanyl–Resulting in Death (DF1)
- Count 2: Special Offender (DF1)
- Count 3: Possession with Intent to Manufacture or Distribute a Controlled Substance (DF2)
- Count 4: Distribution of a Controlled Substance (DF3)
- Count 5: Unlawful Possession of a Controlled Substance (DF4)
- Count 6: Obstructing a Peace Officer (M2)
In addition, our office asked for a $400,000 cash/surety/property bond, which the Court granted.
District Attorney Michael Dougherty stated, “This case underscores the devastating impact of fentanyl. We will continue to aggressively pursue those who distribute fentanyl and hold them fully accountable for preying upon people struggling with addiction. Our office is committed to seeking justice for Mr. Moczulewski and protecting the safety of Boulder County.”
Boulder County Sheriff Curtis Johnson stated, “Our hearts are with the family who lost a loved one in this tragic case. We remain committed to thoroughly investigating fentanyl-related deaths and holding those responsible accountable. We will continue working to shut down the flow of these deadly drugs in our community.”
As in every criminal case, these charges are merely an accusation, and the
defendant is presumed innocent unless or until proven guilty.
