June 27 Public Hearing for Docket DC-24-0002: Text Amendments to the Land Use Code Related to Residential Occupancy

Land Use Code Update Prompted by New State Law HB24-1007, the Harmonizing Occupancy Measures Equitably Act


Boulder County, Colo. - The Board of County Commissioners (BOCC) will hold a public hearing on Docket DC-24-0002: Text Amendments to the Land Use Code Related to Residential Occupancy on Thursday, June 27, 2024, starting at at 9 a.m.

Background and Past Public Hearing

In response to HB24-1007, the Harmonizing Occupancy Measures Equitably Act, which prohibits local governments from limiting occupancy in a dwelling unit based on familial relationship, the Boulder County Community Planning & Permitting Department is proposing a Land Use Code (Code) amendment in Docket DC-24-0002: Text Amendments to the Land Use Code Related to Residential Occupancy.

The proposed amendments to the Code would replace the approach utilizing the term Family with one which would regulate occupancy in residential dwellings based on relevant health and safety standards, instead of familial relationship, to prevent overcrowding and unsafe living conditions. The Code currently utilizes the Family definition to regulate occupancy in residential dwellings.

The Planning Commission reviewed the proposed text amendments at a public hearing on June 12, 2024, and voted 7-0 to recommend approval to the BOCC. View the video recording of the meeting.
