Boulder County Gross Reservoir Community Update
Commissioners’ Town Hall/Community Meeting –
Moved to Tuesday, June 17

The town hall/community meeting originally scheduled for May 6 has been rescheduled to Tuesday, June 17 at the request of community members who will be attending an all-day Denver District Court hearing on May 6.

The new date, June 17, aligns with the Commissioners’ regularly scheduled town hall for the month of June. The time and location will remain the same: 5:30-7 p.m. at the Coal Creek Canyon Community Center. A meeting reminder will be sent closer to the date.

Open Space Purchase - Bearberry Property

On April 3, Boulder County acquired the Bearberry property using proceeds from the Land Preservation Section 5.1 of the Denver Water vs. Boulder County Settlement Agreement.

The county bought the 80-acre three-lot parcel for $1.65 million, leaving approximately $3.5 million in the land preservation fund for future open space purchases. More information on the Bearberry Open Space property is provided below.

Phase II (Tree Removal) – Residential Distribution Payments

As you are likely aware, Judge Christine M. Arguello of the U.S. District Court for the District of Colorado issued orders on April 3 curtailing further construction on the Gross Reservoir dam (Reference: Save the Colorado et. al. vs. U.S. Army Corps of Engineers and Denver Water). Specifically, the court’s orders impose a permanent injunction on tree clearing and other associated activities related to Denver Water's Gross Reservoir expansion project.

Boulder County is closely monitoring the ongoing court proceedings and will evaluate Phase II payments once more information becomes available. The county remains committed to forming a community working group to guide the distribution of Phase II payments. However, the group’s formation may be postponed until 2026, depending on what is learned about the expansion project in the coming months.

"Bearberry" Property Open Space Acquired as Land Preservation Purchase

The Bearberry open space property was acquired on April 3, following community input and approval by the Board of County Commissioners.

In March, the Boulder County Parks and Open Space Advisory Committee and Board of County Commissioners approved the purchase of the Bearberry property using $1.6 million from the Section 5.1 Settlement Agreement funds. The county officially closed on the property on April 3.

The Bearberry parcel is located near the intersection of Coal Creek Canyon Drive and the Peak to Peak Highway and includes important wildlife habitat and wetland protections.

Boulder County Commissioners Town Hall & Community Meeting

Residents are invited to join the Boulder County Commissioners for a Town Hall & Gross Reservoir Community Meeting on Tuesday, June 17.

The commissioners will take questions on any county-related matter.

*Note: The June town hall was rescheduled from May 6 at the request of The Environmental Group and Gross Reservoir community members who will be attending a District Court hearing in Denver that day regarding the question: "What is reasonable and necessary to ensure the structural safety of the (Gross Reservoir) dam as currently constructed."
