Board of County Commissioners Public Hearing, Feb. 12, 2019
On Feb. 12, 2019, staff presented draft proposed text amendments to Articles 1, 3, 9, 17 and 18 of the Boulder County Land Use Code related to Subdivision Exemptions, Exemption Plats, and Building Lot Determinations. The BOCC approved (3-0) the proposed text amendments in Resolution 2019-16, effective March 1, 2019.

Planning Commission Public Hearing – Jan. 16, 2019
On Jan. 16, 2019, staff presented proposed text amendments to the Planning Commission related to Subdivision Exemptions, Exemption Plats, and Building Lot Determinations. Planning Commission voted (6-0) to approve and recommend that the Board of County Commissioners approve the proposed Land Use Code text amendments to Article 9 and associated provisions, including Articles 1, 3, and 18 of the Boulder County Land Use Code as presented in the amended Attachment B of the staff report.

History
On Jan. 18, 2018, the Board of County commissioners authorized staff to proceed with text amendments to the Boulder County Land Use Code related to Subdivision Exemptions, Exemption Plats, and Building Lot Determinations in Docket DC-18-0001. Staff updated Article 9 of the Code to revise the Subdivision Exemption and Exemption Plat Criteria and process. The changes include an administrative process for boundary line adjustments and lot mergers that do not increase density and the revision of the building lot definition in Article 18. The intent of the code amendments was to increase the efficiency of related Land Use Department processes and clarify the intent of Subdivision Exemptions, Exemption Plats, and Building Lot determinations.
Summary of Proposed Text Amendments
The DC-18-0001 amendments to the Land Use Code include the following:
- Clarifications to the building lot definition and building lot determination process, and relocating process-related elements into Article 9
- An administrative process for minor Subdivision Exemptions and Exemption Plats
- Revised Subdivision Exemption and Exemption Plat criteria that more adequately address land use impacts similar to the Site Plan Review and Special Review standards
- Revised Subdivision Exemption definition to address properties with multiple interests where the parcel or lot is not divided.
- Relevant changes to Articles 1-300, 3, 17-300, and 18.
