Boulder County, Colo. - On December 28, at approximately 6:50 p.m., a Boulder Police Department sergeant and an officer attempted to make contact with David Henry Nyquist, D.O.B. 11/28/75, at his residence located on Middle Crest Road, in unincorporated Boulder County. Upon contact, he assaulted the two officers. One officer was treated and released from an area hospital. Both officers sustained minor injuries.

A request was made for emergency cover and Boulder County Sheriff’s Office deputies, as well as additional Boulder Police Department officers arrived on scene. The Boulder County SWAT team, members of the Boulder and Longmont SWAT teams, and negotiators from the Sheriff’s Office and Boulder Police Department were also called out. During the negotiations, Mr. Nyquist also stated that he would voluntarily turn himself into the Boulder County Jail on Friday.

After assessing the risk to both the law enforcement personnel on scene, as well as taking into consideration that his mother was in the house, we decided to use alternative tactics to lessen the risk to all involved, and did not make entry into the house. The Boulder County Sheriff’s Office did, however, continue to have surveillance on Mr. Nyquist throughout the night and into Friday morning.

On Friday morning, at approximately 11:10 a.m., Mr. Nyquist drove his vehicle from his residence on Middle Crest Road to Plateau Road, in unincorporated Boulder County, where he was contacted by the Boulder County Sheriff’s and the Boulder Police Department.

Mr. Nyquist refused orders to exit his vehicle and he was seen with a weapon. Once again, the Boulder County SWAT team, members of the Longmont SWAT team, and negotiators from the Sheriff’s Office and Boulder Police Department were also called out to assist. We also staged medical and fire personnel from AMR Ambulance and Lefthand Fire Protection District in case they were needed. Boulder Emergency Squad and Boulder County Sheriff’s Office Animal Control Officers assisted with road closures. Negotiators made contact with Mr. Nyquist over the phone and eventually he did surrender peacefully.

Mr. Nyquist will be charged by the Boulder County Sheriff’s Office with two counts of Assault in the Second Degree (C.R.S. 18-3-203 (1c)), a class 4 felony and one count of Possessing a Dangerous or Illegal Weapon, (C.R.S. 18-12-102 (1)), a class 5 felony. Additional charges may be pending from other jurisdictions. He is currently booked into the Boulder County Jail.
